Please read these Terms & Conditions carefully before using Bricko. By initiating a conversation with Bricko on WhatsApp, submitting any WhatsApp Flow form, or receiving any message from Bricko, you agree to be bound by these Terms and our Privacy Policy.

Bricko is an AI-powered conversational assistant delivered via WhatsApp, operated by Brickfolio Private Limited. The Service allows you to:

5. WhatsApp Flow Forms — Appointment Booking

5.1 Data Collected

The only data collected through our WhatsApp Flow form is your preferred appointment date and preferred appointment time. No other personal information is requested or collected through this form.

By completing and submitting a WhatsApp Flow form, you expressly consent to:

You are responsible for ensuring that the appointment date and time you select are accurate and reflect your genuine intent. Brickfolio is not liable for missed appointments arising from incorrect form submissions.

5.4 Meta's Role

WhatsApp Flow forms are a feature provided by Meta Platforms, Inc. The technical delivery and rendering of Flow forms is subject to Meta's infrastructure, terms, and policies. Brickfolio is not responsible for technical failures within Meta's platform.

6. WhatsApp Template Messages

Bricko may send you outbound messages using Meta-approved WhatsApp Business Message Templates.

By engaging with Bricko, you acknowledge that you may receive template messages for appointment updates, property information, or re-engagement. All such messages are pre-approved by Meta and comply with WhatsApp Business Policy.

When using Bricko, you agree NOT to:

Your use of Bricko is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By accepting these Terms, you also accept our Privacy Policy.

This Policy forms part and parcel of the Terms of Use. Capitalised terms which have been used here but are undefined shall have the same meaning as attributed to them in the Privacy Policy. This Policy is effective from the date and time a user first interacts with Bricko and accepts these Terms.

10. Accuracy & Confidentiality of Account Information

You are responsible for maintaining the accuracy of any information you provide through Bricko, including appointment selections made through WhatsApp Flow forms. Brickfolio is not responsible for any consequence arising from incorrect information provided by a user.

While Bricko does not manage user accounts in the traditional sense, any contact information or preferences you share in conversation should be kept accurate. You should notify us immediately if you believe any of your information has been compromised.

11. Intellectual Property

All content, branding, logos, and materials associated with Bricko and Brickfolio — including but not limited to the Bricko name, chatbot responses, and website content — are the exclusive intellectual property of Brickfolio Private Limited and are protected by applicable Indian copyright and trademark laws.

You may not reproduce, distribute, modify, or create derivative works from any Brickfolio or Bricko intellectual property without prior written permission.

12. Disclaimer of Warranties

The Bricko Service is provided on an "as is" and "as available" basis. To the fullest extent permitted by applicable law, Brickfolio makes no warranties, express or implied, regarding:

Bricko's responses are generated by automated AI systems and may occasionally be inaccurate. Users should independently verify all important information before making real estate decisions.

13. Limitation of Liability

To the maximum extent permitted by applicable law, Brickfolio shall not be liable for any indirect, incidental, consequential, special, or punitive damages, including but not limited to:

You agree to indemnify, defend, and hold harmless Brickfolio Private Limited, its officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, and expenses (including legal fees) arising out of or related to:

You may discontinue use of Bricko at any time by ceasing to send messages and blocking the Bricko number. Upon termination, your data will be handled in accordance with our Privacy Policy.

16. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of India, including the Information Technology Act, 2000, and the Real Estate (Regulation and Development) Act, 2016, without regard to conflict of law principles.

Any disputes arising out of or in connection with these Terms shall first be attempted to be resolved through good-faith negotiation. If unresolved within 30 days, disputes shall be submitted to the courts of competent jurisdiction in Maharashtra, India.

We reserve the right to change these Terms at any time. Changes will be effective immediately upon notice.
